Terms of Service

These terms govern the use of ODTE GEX (the “Service”), offered under the trade name “PueNYC”. By requesting info, activating a trial or using the software, you accept these terms. If you don’t agree, don’t use the Service.

Important: ODTE GEX is an information and analysis tool. It is not financial advice or a recommendation to buy or sell, and it does not guarantee results. Trading futures and options involves risk of loss. See section 7.

1. What the Service is

ODTE GEX is Windows software that shows 0DTE option levels (GEX), iceberg detection on the tape, and a live-calibrated QQQ-to-NQ conversion, plus the associated website. It is an information tool: it does not place orders or manage money for you.

2. License to use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use ODTE GEX according to your plan. Except where the law expressly allows, you may not:

  • Share, resell, rent, sublicense or distribute your key or the software.
  • Use one license on more machines than allowed (by default, one).
  • Reverse engineer, decompile, or attempt to extract the secrets, the computation model, or to bypass the licensing and anti-piracy mechanisms.

Each delivered copy is individually watermarked per license (traitor tracing). If a copy or its data is leaked, we can identify which license it came from and revoke it.

3. 7-day trial

We may offer a 7-day free trial. The trial is for evaluating the product, is normally limited to one per person/machine, and expires automatically at the end of the period. It creates no obligation to buy.

4. Pricing, subscription and renewal

Licenses are monthly, month-to-month: 30 days per license, one machine per license. We do not offer annual, semi-annual or longer plans, and there is no commitment or automatic renewal. When the month ends, the software stops working until you issue or renew the license. Prices may change; launch pricing applies for the period stated on the site.

No prorated refunds. Except where required by law, a period that has already started is not refundable: we charge per full month, not per day. If you don't want to continue, simply don't renew the following month and there's nothing else to do. The 7-day trial (section 3) is the way to evaluate at no cost; use it before paying.

5. Requirements and third-party services

To work, ODTE GEX requires a Windows PC, NinjaTrader 8 and a Tradier account. These are third-party services: you sign up for, install and pay for them yourself, and they are governed by their own terms and costs. We are not responsible for their availability, pricing, data accuracy, or changes to them. If you open your Tradier account through our referral link, we may receive a benefit; the referral price is for you.

6. Acceptable use

To use the Service you must be at least 18 years old. You agree to use the Service lawfully, not to share your key, not to breach its security or licensing, and not to use it for illegal activities. Violations may result in immediate suspension or revocation of your license.

7. Informational nature — no advice, no guarantees, real risk

  • ODTE GEX is not financial, investment, legal or tax advice, nor a recommendation to buy or sell. The decisions — and the risk — are yours.
  • We do not promise or guarantee profits or results. It is one more tool a trader uses, not a magic formula.
  • Trading futures and options carries high risk: you may lose some or all of your capital. Never trade with money you cannot afford to lose. Past performance does not guarantee future results.
  • Data, levels, verdicts and examples may contain errors, delays or interruptions. Always verify with your broker before deciding.
  • Consult a licensed professional before trading.

8. Intellectual property

The software, the computation model, the brand, the site and its content are the property of the operator of ODTE GEX. The license transfers no ownership to you; only the right of use described here.

9. The Service is provided “as is”

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or continuous availability.

10. Limitation of liability

To the maximum extent permitted by law, ODTE GEX / PueNYC and its principals will not be liable for trading losses or for indirect, incidental, special or consequential damages arising from the use or inability to use the Service. In any case, our total aggregate liability is limited to the amount you paid for the Service in the 3 months before the event giving rise to the claim.

11. Suspension, termination and refunds

We may suspend or revoke your license if you breach these terms (for example, key sharing, piracy, or a chargeback). Upon termination, you must stop using the Service. The 7-day trial is the way to evaluate the product at no cost; therefore, except where required by law, subscriptions are non-refundable once the period has started.

12. Changes to these terms

We may update these terms. If we make material changes, we’ll update the date above. Continued use of the Service means you accept the current terms.

13. Governing law and jurisdiction

These terms are governed by the laws of the State of New York (USA), without regard to its conflict-of-laws rules. Any dispute will be submitted to the competent courts located in the State of New York, unless a mandatory rule of your place of residence provides otherwise.
