Privacy Policy

This policy explains what personal data ODTE GEX (trading as “PueNYC”) collects, why, who we share it with, and the rights you have. We wrote it in plain language on purpose. If anything is unclear, email us at licencias@puenyc.com.

1. What data we collect

a) When you request info or a trial (site form)

  • Name and email.
  • Country (optional).
  • Whether you have NinjaTrader 8 and/or a Tradier account (yes/no).
  • Any message you send us (optional).
  • Technical request data: IP address and browser (user-agent), kept for abuse prevention and security.

b) When you activate a license or trial of the software

  • The email tied to the license.
  • A machine identifier (derived from your device) to enforce the “one machine per license” limit.
  • IP address, client version, and activation and periodic check-in (heartbeat) timestamps.
  • Technical logs needed to run and protect the service, including detection of shared or leaked licenses (anti-piracy).

c) Emails

When we reply to you or send your license, we process your email through our email provider. We do not use your email for advertising.

We do not collect card or bank credentials, and we never enter your broker passwords: you open and manage your Tradier account directly with them.

2. Why we use your data

  • To answer your inquiries and issue trials or licenses.
  • To deliver the software, your license key and updates.
  • To enforce license terms (one machine per license) and prevent piracy, fraud and abuse.
  • For security, diagnostics and the proper functioning of the service.
  • To comply with legal obligations where applicable.

We do not make automated decisions or profiling that produce legal effects on you or similarly affect you. Anti-piracy detection flags patterns (IPs, machines) but the final decision to revoke a license is made by a person.

3. Legal basis (if you are in the EU/EEA or UK)

  • Your consent, when you submit the form.
  • Performance of a contract, to issue and deliver your license.
  • Legitimate interest, for security, abuse prevention and the product’s anti-piracy protection.

4. Who we share data with

We do not sell your personal data or share it for advertising. We share it only with providers that help us operate, and only as needed:

  • Hosting (Vultr): our servers, where data is stored.
  • Email (Namecheap Private Email): to send you emails from licencias@puenyc.com.
  • Payments (future): card payments on the site are currently disabled. If we enable them later, the processor (e.g., Stripe) will receive the payment details you enter directly on its platform; we do not see or store your card number.
  • Tradier / NinjaTrader: third-party services you sign up for and install yourself. If you open your Tradier account through our referral link, we may receive a benefit from Tradier, but we do not send them your personal data; your relationship with them is governed by their own policies.
  • Authorities: if required by law.

5. Cookies and tracking

This site does not use tracking or advertising cookies, nor analytics tools (no Google Analytics, no social pixels, etc.). The form works without cookies. The ODTE GEX dashboard runs locally on your PC.

6. How long we keep data

  • Form inquiries: as long as useful to reply to you and as a reasonable contact record. You can request deletion at any time.
  • License data: while the license is active and for as long as needed to enforce it, for security, and for legal obligations. Some minimal records (e.g., revoked licenses or anti-piracy watermarks tied to an issued license) may be retained even after a deletion request, to the extent needed to protect the service.
  • We keep backups with a retention of up to 30 days; after that period, a record deleted on your side also disappears from the backups.

7. Your rights

Depending on where you live, you may have the right to access, correct, delete, restrict or object to the processing of your data, and to data portability. If you are in California (CCPA/CPRA), you have the right to know what data we hold, to request its deletion, and to opt out of its sale (we don’t sell it). To exercise any of these, email licencias@puenyc.com and we’ll respond within a reasonable time. You can withdraw your consent at any time (without retroactive effect).

8. International transfers

Our servers are in the United States. If you contact us from another country, your data is transferred to and processed in the U.S. under this policy.

9. Security

We use reasonable measures (encrypted TLS connections, access control on admin systems, secrets kept out of the client) to protect your data. No system is 100% foolproof, but we handle your information with care.

10. Minors

ODTE GEX is a tool for trading financial markets and is not directed to anyone under 18. We do not knowingly collect data from minors.

11. Changes to this policy

We may update this policy. If we make material changes, we’ll update the date above and, where appropriate, notify you.
